Next Sky Tech is a digital services company operating as part of Six Side Media Inc., headquartered in Markham, Ontario, Canada. We provide website design & development, web application development, mobile application development, SEO, digital marketing, and realtor website solutions with CRM integrations.

To use our services, you must:

• Be at least 18 years of age or the age of majority in your jurisdiction.
• Have the legal authority to enter into a binding contract on behalf of yourself or your organization.
• Provide accurate, current, and complete information during the registration and onboarding process.

Next Sky Tech offers the following services, subject to the selected pricing plan:

• Website Design & Development – Custom, responsive, SEO-optimized websites.
• Web Application Development – Scalable web applications tailored to business needs.
• Mobile App Development – Real-time and cross-platform mobile applications.
• Realtor Websites & CRM – MLS-integrated websites and powerful CRM tools for real estate professionals.
• SEO & Digital Marketing – Search engine optimization and targeted digital campaigns.

Service availability, features, and deliverables are defined in your selected plan or a separate written agreement.

Certain services are offered on a recurring subscription basis starting from $15 per month. By subscribing:

• You authorize us to charge the applicable subscription fee to your payment method on a recurring basis.
• Subscriptions automatically renew at the end of each billing period unless cancelled prior to the renewal date.
• You may cancel your subscription at any time through your account settings or by contacting our support team. Cancellation takes effect at the end of the current billing cycle.
• We reserve the right to modify pricing with at least 30 days' prior written notice to you.

To access certain features, you must register for an account. You are responsible for:

• Maintaining the confidentiality of your login credentials.
• All activities that occur under your account.
• Notifying us immediately at info@nextskytech.com of any unauthorized access or breach.

We reserve the right to suspend or terminate accounts that violate these Terms or are associated with fraudulent activity.

You agree not to use our services or platform to:

• Violate any applicable local, provincial, national, or international law or regulation.
• Transmit any content that is unlawful, defamatory, harassing, infringing, or otherwise objectionable.
• Attempt to gain unauthorized access to our systems, networks, or user data.
• Distribute malware, viruses, or any other harmful software.
• Impersonate any person or entity, or misrepresent your affiliation.
• Engage in any activity that could damage, disable, or impair our services or infrastructure.

All content, logos, trademarks, software, templates, code, and materials created by or for Next Sky Tech remain the intellectual property of Six Side Media Inc., unless otherwise agreed in writing.

Upon full payment for a project or while an active subscription is maintained, you are granted a limited, non-exclusive, non-transferable license to use the deliverables for your own business purposes. You may not resell, sublicense, or redistribute our proprietary templates or code without express written consent.

By submitting logos, images, text, or other materials for use in your project, you represent and warrant that you own or have the necessary rights to those materials. You grant Next Sky Tech a license to use them solely for the purpose of delivering your requested services.

Our services may integrate with or link to third-party platforms (e.g., MLS providers, payment processors, CRM systems). We are not responsible for the terms, privacy practices, or performance of any third-party services. Your use of third-party integrations is governed by those parties' own terms and policies.

Our services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that our services will be uninterrupted, error-free, or free of harmful components. We make no guarantees regarding specific search engine rankings or marketing outcomes.

To the fullest extent permitted by applicable law, Next Sky Tech and Six Side Media Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, loss of data, or loss of business opportunities, arising from or related to your use of our services.

Our total cumulative liability to you shall not exceed the total amount paid by you to us in the three (3) months immediately preceding the event giving rise to the claim.

You agree to defend, indemnify, and hold harmless Next Sky Tech, Six Side Media Inc., and their respective officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of or in connection with your use of our services, your violation of these Terms, or your infringement of any third-party rights.

We reserve the right to suspend or terminate your access to our services at our discretion, with or without notice, for conduct that we determine violates these Terms, is harmful to other users, or is detrimental to our interests. Upon termination, your right to use the services ceases immediately.

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Ontario, Canada.

We reserve the right to update these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of our services after any changes constitutes your acceptance of the revised Terms.

These Terms, together with our Privacy Policy, Refund Policy, and Cookie Policy, constitute the entire agreement between you and Next Sky Tech regarding your use of our services and supersede all prior agreements and understandings.
